Memorandum of Understanding on Cooperation Between The Institute of Diplomacy of the Academy of Public Administration under the President of the Republic of Kazakhstan And Emirates Diplomatic Academy

 

 

THIS MOU is made on the 30 day of April, 2017 by and between:

 

  1. The Institute of Diplomacy of the Academy of Public Administration under the President of the Republic of Kazakhstan, represented herein by Dr. Anuar Ayazbekov in his capacity as the Director (hereinafter referred to as the “First Party”)

And

  1. Emirates Diplomatic Academy, represented herein by His Excellency Bernardino León in his capacity as EDA Director General (hereinafter referred to as the “Second Party”).

 

Both parties are hereinafter referred to collectively as the “parties”,

 

Preamble

Whereas the Emirates Diplomatic Academy and the Institute of Diplomacy of the Academy of Public Administration under the President of the Republic of Kazakhstan wish to enhance their cooperation in their respective fields and to develop friendly and cooperative relations in the fields of training highly qualified civil servants and research,

 

NOW THEREFORE, both parties agree as follows:

 

Article (1)

The above preamble shall form an integral part hereof and be read herewith.

 

Article (2)

Objectives and Fields of Cooperation

Both parties desire to explore cooperation at the following fields:

  1. Joint educational, training and/or research activities.
  2. Sharing of experience, and exchange of visits and invitations to scholars for participation in conferences, symposia and seminars
  3. Exchange of information in fields of interest to both parties.
  4. Exchange of faculty, research personnel and students for study and research.
  5. Practical training in pre-identified or otherwise selected field sites as mutually agreed.

 

Article (3)

Before proceeding with any of the activities set forth in the previous article, the parties shall discuss whether it is advisable to enter into a Specific Agreement that includes additional terms and conditions regarding costs, intellectual property, liability, and other matters as the circumstances may require

 

 

 

 

 

Article (4)

Obligations of the Parties

To implement the MOU the parties seek to achieve the following:

  1. Ongoing communication for sharing essential information in a timely manner.
  2. Neither party shall have any financial obligations to the other party based on this MOU. Any financial obligations necessary to implement this MOU must be separately discussed between both parties and will depend upon availability of funds.
  3. Realization of separate concrete projects within the frames of the MOU will be stipulated in separate, Specific Agreements.  

 

Article (5)

Financial Arrangements

This MOU is not a commitment of any funds.

 

Article (6)

Duration and Termination

This MoU is at-will and may be modified by mutual consent of authorized officials from either the First Party and/or the Second Party.  This MoU shall become effective upon signature by the authorized officials from the Parties and will remain in effect until modified or terminated by any one of the Parties by mutual consent.

 

 

Article (7)

General Provisions

  1. The MOU will be in force for 5 years and may be renewed upon written agreement of the parties for subsequent terms. Either party wishing to make changes or terminate the MOU shall notify the other partner in writing of such intentions no later than 3 months before the suggested changes come into effect.
  2. This MOU shall not result in any legal liability to both parties and shall not modify or cancel any applicable regulatory requirements at either institution.
  3. Either party may, at any time, request amendment of any articles of the MOU upon mutual agreement with the other party.
  4. If the Parties decide to work together on a particular project that may incur expenses and/or elaborate work(s), then they shall enter into a legally binding agreement or other contractual arrangement bespoke to the given project.

 

 

 

  1. The MOU supersedes all previously made oral or written agreements or protocols between the parties relating to its subject.

 

Article (8)

Liability

Either party shall be fully liable to their contractual commitments with the third party, and no third party shall be entitled to recourse to either party herein due to any omission or negligence from the other party.

 

Article (9)

Copies of the MOU

This MOU is executed into two duplicate copies in English, two duplicate copies in Arabic, and two duplicate copies in Kazakh all texts being equally authentic. In case of any differences, the English text shall prevail.

 

Article (10)

Notices and Communications

  • All notices or other communications hereunder shall be addressed in writing or electronically to respective addresses of both parties or any other addresses as outlined by either party from time to time.
  • Both parties will communicate together on the below addresses:
